Revised Pay Structure of Teaching & Non-Teaching Staff of the Directorate of Staff Development Punjab

U.O No. FD.SR-II-9-82/2005 dated 17th January 2014 has been issued by the Govt of Punjab Finance Department in connection with Revised Pay Structure of Staff of the Directorate of Staff Development Punjab. This includes teaching and non teaching staff.

In continuation letter No. FD.SR-II-9-82/2005 dated 06-07-2005 and Education Department Notification No. US(TRG)2-6/2004 dated 15-07-2005.the Competent Authority i.e Chief Minister Punjab has now been pleased to revise the following pay structure/allowances for the staff posted or to be posted in future in the Directorate of Staff Develpoment Punjab, Wahdat Colony Lahore wef 01-01-2014.

The above pay structure/allowances are subject to the condition that a review will be held in July 2014 to ascertain the following areas in order to have decision regarding continuity of benefits:

i-                    As to whether all posts have been filled in or otherwise.

ii-                   Frequency of visits and feed back in this regard.

iii-                 Number of trainings arranged by the DSD.

Detail of Move Over With Example of Stenographers

Today I am giving here the detailed description about the Move Over with the example of stenographers. As many visitors of mine site inquired about the move over frequently, so I requested Mr. Shaheen Rehman to write a detailed note on it. With his efforts I am able to publish the same here.  

NON-GRANT OF MOVE OVER BS-17 TO STENOGRAPHER BS-12, AWARDED SELECTION GRADE BS-15 (ON SENIORITY OF BS-12) GRANTED MOVE OVER BS-16 & ULTIMATELY RE-FIXED IN BS-15 ON DISCONTINUATION OF MOVE OVER POLICY IN, 2001. 

SHORT BRIEF ABOUT MOVE OVER

 As per Punjab Civil Servants Pay Revision Rules, 1977, S.No. 8 (1) A civil servant holding post in Revised National Pay Scale No. 1 to 15 who has reached the maximum of a Revised National Pay Scale shall be allowed the next higher Revised National Pay Scale with effect from the 1st day of December of the year in which he completes one year of such service at the said maximum as counts for increment under the rules, subject to the conditions that:-

(i) there is no adverse entry in his Annual Confidential Reports for the last four years. If this condition is not fulfilled, he shall wait at the said maximum till he has earned in succession four Annual Confidential Reports without any adverse entry. His move over to the next higher Revised National Pay Scale shall take effect from the 1st day of December of the year in which he fulfills this condition.

As per pay Revision rules, 1983,  (i) The existing provisions regulating the concession of move-over without promotion to the next higher pay scale of employees in Revised National Pay Scale 1(B-1) to Revised National Pay Scale 16 (B-16) shall continue to be applicable in this Scheme.

AS PER FEDERAL GOVERNMENT ESTA CODE FOR GRANT OF CONSECUTIVE MOVE OVER Grant of move over to Government Servants in BPS-1 to 15

BPS-15 employees are entitled to consecutive and automatic grant of move over on reaching the maximum of their Pay Scale, subject to the condition that they fulfill other requirements.  In their case neither D.P.C. nor Move Over Committee has any role to play.  However, the grading/standard of their A.C.Rs is to be ensured by respective administration.

However, as per Move Over Policy of the Government of the Punjab, vide No. FD.PC-1-1/77 Dated 31/8/1989, It has been clarified “The Administrative Department is advised that the restriction of two or more successive Move Over applicable to employees in BPS-16 & above”.

Further as per Government of the Punjab Industries & Mineral Department Notification No. SO(TECH)2-97/95 Dated 3/2/1998, regarding clarification of Successive Move Over holding Post BS-1 to BS-15,  addressed to the Managing Director Punjab Small Industries Corp. Lahore, it has been narrated that:-

“I am directed to refer to your letter No. PSIC/ Admn /A.D. (A)/ Misc-219/9645, dated 15-1-1998, on the subject cited above and  have to clarify that since the official is working as Stenographer BS-12 and drawing pay in Selection Grade BS-15,  is not an officer of Grade-16 and above, therefore, he is entitled for  Successive  Move Over as the restriction of 2 or more successive Move Over applies to the employees in BS-16 & above only, in accordance with the instructions of Finance Department contained in their U.O. No. FD.PC-8-1/77, dated 31-1-89”.

CASE HISTORY

Stenographer BS-12, granted Selection Grade BS-15 (Based on the seniority of Stenographers BS-12), was allowed Move Over BS-16 (2535-197-5490) w.e.f. 1/12/1994.  After grant of Annual increments due on 12/1995, 12/1996, & 12/1997, reached at the maximum of BS-16 Rs. 5490/-, and thus in the light of notifications quoted above, eligible for the grant of Move Over-BS-17, w.e.f. 1-12-1998.

Although Mover Over BS-17 was allowed by the competent authority w.e.f.1/12/1998, but the District Accounts Officer Vehari, has not honored this order, with the plea that as the BS-17 is a Gazetted scale, therefore, it cannot be granted to a Steno as Move Over, returned the fixation case in Service Book with the remarks that “the official is already in Move Over BS-16 and holding the Non Gazetted post, so BS-17 is not admissible till the regularization of BS-16.

            Keeping view the all above facts and notifications, the Stenographer was entitled for the grant of Move Over BS-17, w.e.f. 1/12/1998, but due to objection raised by District Accounts Officer Vehari, deprived from the grant of BS-17 as Move Over and thus facing financial hardships continuously, and may be up to the retirement.  

The Punjab Esta Code 2008, also reflects the policy of move over with dissimilarity that BS-17 cannot be allowed to those who granted Move Over BS-16, till they are promoted to BS-16 on regular basis, vide No.FD.PC-8-1/83 Dated the 4th October 2001, having the subject as : CLARIFICATION REGARDING AWARD OF CONSECUTIVE MOVE-OVER, it has been cleared that “I am directed to refer to the subject noted above and to state that a doubt grant of consecutive move-over to BS-17 was prevailing for employees drawing pay in BS-1 to BS-15.

2. It is clarified in consultation with the Federal Government that such employees are entitled to the grant of move-over upto BS-16 only. They are not entitled to further move-over to BS-17 till such time they are granted BS-16 on regular basis.

The above notification thus conceal the move over policy stating that successive move over can be granted to the employees of BS-1 to BS-15, because as per this Esta Code Notification, the policy must be replaced that successive move over can only be granted to the employees of BS-1 to BS-14, but BS-15 employees for only one time? 

Due to non award of Move Over, the annual increments being at the maximum of BS-16, (and non grant of Mover Over BS-17) due on 1/12/1998, 1/12/1999, & 1/12/2000 could not be availed.  However, on revision of pay scales 2001, and discontinuation of Move Over Policy, was fixed in  original Selection Grade BS-15, (Seniority still fall under Stenographer BS-12) and now availing the annual increment benefit after the fixation of pay in BS-15 w.e.f. 1/12/2001. 

It is mentioned over here that had the BS-17 granted as Move Over, then ultimately on discontinuation of Move Over Policy 2001, the stenographer would have to be re-fixed in his original Grade BS-15 (Selection Grade). 

            Further, the status of posts i.e., gazette/non gazetted are ever declared by the Government, but the grant of scale never mean their automatic conversion as Gazetted, as clarified vide Government of the Punjab No. FD.PC. Dated Endst. No. & further endorsed by Director (Field) Water Management  Multan No. 14268-91 Dated 13/7/87: (a) the officials who have been given BS-16 by Move Over or those who get BS-16 as selection grade are  allowed BS-17 by Move Over, shall continue to draw their salaries through pay bills used for government servants classified as Non-Gazetted. (b) where the posts have been placed/upgraded to BS 16 on regular basis, the incumbent will draw their salaries on pay bills used by the category of Government Servant formerly classified as gazette officers. 

RECOMMENDATIONS

             It is therefore necessary that this ambiguity in grant of Move Over BS-17, to all such employees must be removed and cleared, so that the financial benefits due to them can be availed by them.

Demand for Grant of Pay Scale Instead of Fixed Pay Package to the MEAs

The Punjab Mohtsib has given its decision on 21-01-2014 in connection with the demand for Grant of Pay Scale Instead of Fixed Pay Package to the MEAs on Analogy of other Contract Employees of School Education Department. The detail of this decision is as under:

Complaint

Mr. Munir Ahmed and other two Monitoring Evaluation Assistants (MEAs) (contract appointees) of the Chief Minister Monitoring Force (Education Department) stated that despite their service form 2004, their fixed Pay Package was not appropriately revised, dearness increases of 2009, 2010 were not allowed and they were not allowed corresponding pay scales, as against the fact that the other contract appointees of the Education Department were awarded corresponding pay scales, in replacement of their fixed pay package. They seek a direction to the Education and Finance Departments to revise their pay package, grant them Pay Scales and remove discrimination, as well as, the MEAs in various Districts of the Punjab were. in receipt or higher rate of pay that may be examined and that rate of pay be allowed to them at Lahore.

Report of the Agency

2. The A.G. Punjab vide report dated 09.10.2013 stated that the complainants were allowed the fixed pay package as per the School Education Department order dated 29.02.20 12. The School Education Department vide report dated 26.01 .2013 stated that fixed pay package was lastly enhanced on 29.02.2012, whereby the Adhoc Relief/Dearness Allowance ie 20% (2009) and 50% (2010) were not admissible. However, in some Districts, the MEAs succeeded to get those increases from the DAOs and their pay was un-authorizedly increased, which was accordingly remedied.

4. In their further report dated 04.12.2013, the School Educational Department interalia, reported that fixed pay package of MEAs was increased by 35%.

Joint Hearing

5. Joint hearing were held on 06.11.2013 and 26.11.2013. Surprisingly both parties repeated the same arguments. The aggrieved employees reiterated that it was clear case of discrimination and exploitation of weaker and poor helpless segment of the employees. A delegation of these employees was also present during joint hearing.

Proceedings

6. Mr. Umar Atta Bandial Honourable Judge, Lahore High Court, Lahore in W.P. No.124/88/2011 field by Rana Ishfaq Ahmed. etc. MEAs vide order dated 13.09.2011 asked the Secretary Education (Schools) and the' Secretary (Finance) to consider the petition of the petitioners for enhancement of pay as it was allowed to the other staff members in the same project, as well as, to pay their emoluments in accordance with the scales as granted to other staff members, pursuant to letter dated 28.04.2008. Needful was directed to be done within two months from the date of receipt of the copy of the order dated 13.09.2011.

7. Aggrieved by the order of the Respondents, the petitioner (lshfaq Ahmed) moved contempt petition Crl. Org. 495/2012 in W.P. No.124/M8/2011 which was disposed or by the Honourable Lahore High Court vide order dated 17.05.2012, that the petitioners were aggrieved of the conclusion and result of the impugned order whether the same arrived at a right or wrong conclusion is a matter of substance which is not liable to challenge in the contempt jurisdiction of the Court. By passing the impugned order the direction of the Court stands complied. The petitioners, if so inclined, avail their remedies against the impugned order in accordance with law.

Findings

8. It is a fact that the various categories of the contract employees of the Chief Minister's Monitoring Force, Education Department, Government of the Punjab were allowed pay scales against the fixed pay package with immediate effect vide the Education Department order No. DD(M)8-34/04, dated 28.04.2008, The complainants were also the contract employees of the project of the School Education Department and were entitled to the same treatment as was extended to other employees vide order dated 28.04.2008. There were no solid reasons to refute the demand of the petitioners.

9. The record and performance of these monitoring teams was also examined. It was an admitted fact that the complainants required performance was not less than others. They were qualified for the job and their reported output was outstanding. Based on these reports they stood entitled to the same treatment as was given to others. Non implementation of the same treatment will be maladministration and discrimination as defined under the Ombudsman Act, 1997.

10. The Secretary, School Education Department and the Secretary Finance Department are directed to allow pay scales to the complainant including all those MEAs similarly placed and circumstanced and report compliance to this office within one month from issue of this order as required under Section 11(2) of the O/o Ombudsman Act, 1997.

Conditions for M.Phil Allowance EDO (Education) Toba Tek Singh

 

Only One M.Phil Allowance will be admissible.

M.Phil Allowance may not be admissible to those who have already drawn Four/Six Advance Increments on acquiring of M.Phil.

M.Phil Allowance will be admissible to those who have acquired M.Phil during Extra Ordinary Leave (Two Years) already drawn two advance increments.

The District Accounts Officer concerned is required to check all codal formalities before any kind of payments.

Moving One Scale Up of the Employees of BPS-01 to BPS-04 wef 01-07-2007

Govt of Pakistan Finance Division Regulation Wing has issued Notification No. F.No.2 (5) R.1/2008 dated 27th January 2014 in connection with the clarification of Moving One Scale Up of the Employees of BPS-01 to BPS-04 wef 01-07-2007.

It is clarified that the orders contained in Para 2 of the Notification No. F.6 (4) R.1/2006 dated 29th July 2007 of the Upgradation of Clerical/Auditors Posts, allow all the existing employees of BPS-01 to BPS-04 to move one scale up (i.e to next higher pay scale) w.e.f 01-07-2007 without any discrimination and irrespective of the fact whether they were allowed Selection Grade or not.

The above clarification will take effect from 01-07-2007 and all the clarifications previously made in this regard shall be deemed to have been modified to the extent indicated above.

Clarification of Supreme Judicial Allowance

Office of the Accountant General Pakistan Revenues, Islamabad has issued Circular No. TM/18-64/Circular of Higher Authority/2013-14/1845 dated 11-02-2014 in connection with the Clarification of Supreme Judicial Allowance.

According to this circular, after thorough deliberations of Higher Audit Cell of the office, the admissibility of Supreme Judicial Allowance, which is meant for the honourable judges of Supreme Court of Pakistan and the High Courts for specific judicial duties they are performing, is not admissible to other public functionaries. Therefore the payment of Supreme Judicial Allowance already made to other than judges of Supreme Court of Pakistan and the High Courts may be stopped forthwith and the over payment made to non-entitled may be recovered from either their salaries or pension as per rules.

This is issued with the approval of Accountant General of Pakistan Revenues.

SO (TRG)2-4/2014 dated 12th February 2014 in connection with Revised Pay Structure/Allowances for TEs & DTEs Posted in DSD Punjab, Lahore. According to this Notification, The Chief Minister has pleased to approve the the following revised pay structure/allowances for the staff posted or to be posted in future in DSD, Punjab wef 01-01-2014.

Decision Copy February 2014 of 20% Special Relief Allowance for All FG Employees

The Islamabad High Court has again issued the orders on 4th February 2014 in connection with the 20% Special Relief Allowance 2013 to all the Federal Govt Employees and the deadline has been given till 28-02-2014. Some points of this decision are as under:

Official in attendant submit that the summary with regard to Special Allowance @ 20% was submitted to the Honourable Prime Minister for approval and there were certain quarries, however after answering the same summary has been again submitted to the Honourable PM for taking final decision about the matter. Further submit that they are not in position to tell any specific date for the approval of the summary, however showed their expectance that the same will be returned within three weeks. Officials in attendant are directed to submit follow up letter in terms of order passed by this court so that this issue may be settled as the employees of different departments are lurking in the arena of uncertainty since long and approaching the court time and again. It is expected that the authority shall take the final decision by the end of this month i.e 28-02-2014.

In view of the matter, it is held that all the Federal Govt Employees and the employees of other allied departments are equally entitled to 20% special allowance which has been given to the employees mentioned in the Notification.

30% Special Secretariat Allowance for KPK Secretariat Employees

Government of the Khyber Pakhtunkhwa, Finance Department has issued Notification No. FD (PRC) 1-1/2014 dated 17th February 2014 in connection with the 30% Special Secretariat Allowance for the employees of Civil Secretariat, Chief Minister’s Secretariat, and Governor’s House/Secretariat Khyber Pakhtunkhwa with effect from 1st March 2014.

According to this Notification, competent authority has been pleased to unfreeze the 30% Special Allowance sanctioned vide Notification No. FD (SOSR-II) 8-7/2011 dated 27th April 2011 and it has been allowed on the Running Basic Pay of the concerned employees.

This Special Allowance shall be admissible on the running basic pay subject to the conditioned prescribed in the aforesaid Notification dated 27-04-2011 or it may be prescribed by the Governor from time to time.

Appointment of an Officer of Lower Grade to a Post of Higher Grade and Grant of Pay of the Higher Post-Notification of Sindh Govt 2006

Government of Sindh, Finance Department has already issued Notification No. FD/SR-I/1(63)/2005 dated 7th January 2006 in connection with the Grant of Pay of Higher Post to the Officer of Lower Grade appointed on the Higher Post.

According to this Notification, the courts held from time to time that where a civil servant is called upon to discharge duties and responsibilities of a higher post, he is entitled to pay of the higher post. The Law Department in their U.O No. OP (23)/86/378 dated 26th October 1986 issued necessary guidelines in this regard. To further clarify the matter, it has been decided that the pay of the higher post will be admissible to Civil Servants during the period of appointment on higher post subject to the following conditions:

  • The officer has been appointed on higher post by the authority competent to make appointment on that post.
  • The officer is fully qualified in every respect to be appointed to that higher post.
  • The officer discharges all the duties and responsibilities of the higher post independently and serves all connections with his lower post.
  • The pay of the higher post will be fixed presumptively with effect from the date of officer assumes the charge of the higher post and it will include the increments of the pay scale of the higher post for the period of higher post appointment on that post.
  • On relinquishing of charge of the higher post or on transfer or on regular promotion to that higher post, the pay will be re-fixed with reference to original scale of pay of the officer and increments earned (if any) on higher post will count for increments in his original scale as per provisions of Rule 50 of SCSR Manual (Vol: 1).
  • The pay of the higher post will be given only with the concurrence of Finance Department.

All Administrative Secretaries to Government of Sindh are advised that only those cases may be referred to Finance Department which are covered under sub-paras (i) to (iii) of para-I above and pay of the concerned officers may be fixed/re-fixed in terms of sub-para (iv) and (v) above after obtaining prior concurrence of the Finance Department.

Grant of Special Pay Equivalent to Three Times of Basic Pay & Utility Allowance to the Employees of Special Courts-Decision of the LHC Rawalpindi Bench

The Lahore High Court, Rawalpindi Bench, Rawalpindi has given its decision on 19-02-2014 in connection with the Grant of Special Pay Equivalent to Three Times of Basic Pay  & Utility Allowance with effect from 01-03-2010 to the Employees of Special Courts performing their duties in connection with administration of justice under the administrative control of Ministry of Law & Justice Division, Islamabad. The detail of this decision is as under:

  • Through this constitutional petition, the petitioners employees of Special Courts performing their duties in connection with administration of justice under the administrative control of Ministry of Law & Justice Division, Islamabad pray for giving effect to the recommendations of National Judicial Policy Making Committee and grant them the Special Pay equivalent to three times of the Basic Pay, Utility Allowance wef 01-03-2010as has been done in case of the other judicial officers and staff of the district judiciary, members of the staff of the Federal Courts, the Courts subordinate to the Sindh High Court, Karachi and the Tribunals in the light of the judgment dated 31-10-2012, passed in writ petition No. 20968 of 2009 by this court.
  • Learned Council for petitioners relying on the judgment dated 31-10-2012, referred to above and the judgment dated 21-03-2013, passed in writ petition No. 536/2013 by the Islamabad High Court, Islamabad, contends that the petitioners contemporaries performing their duties under the Ministry of Law and Justice Division and serving in the Courts subordinate to Sindh High Court, Karachi and Islamabad High Court, Islamabad, have already been granted the relief prayed for in this petition. The same relief cannot be withheld in case of the petitioners; that the judgments passed in above referred cases, are in fact, the judgments in rem and confer same rights to the petitioners and all the other performing similar duties under the Special Courts.
  • The petition is opposed by the Learned AAG and Standing Counsel. It is contended that the judgments, referred to above, by the learned counsel for the petitioners, are not judgments in rem. The same confer the prayed relief to those only who had come forward to seek the relief, contends that an I.C.A has already been filed in LHC, Lahore against the judgment dated 31-10-2012. They, however, concede that no injunctive order has been passed therein. They request that till the decision of the said I.C.A, this petition may be kept pending; that acceptance of this appeal will open a Pandora’s Box and will be a sever slash on the National Exchequer.
  • Heard. Record perused.
  • The contemporaries of the petitioners who had filed writ petition No. 20968/2009, at the Principal Seat of this Court, have vide judgment dated 31-10-2012, been granted the relief, as is prayed for in this petition. The same was the outcome of Writ Petition No. 536 of 2013, filed in IHC, Islamabad, which culminated in the judgment dated 21-03-2013. The judgment passed in Writ Petition No. 20968/2009 is a judgment in rem and the benefits conferred upon those petitioners should have also been extended to the present petitioners. There is no reason to refuse the instant petitioners the relief they are entitled to have. Mere pendency of an I.C.A does not put a legal restraint on this Court to adjudicate upon this petition. In these circumstances, relying upon the dictum laid down in the supra judgments, this petition is accepted. The petitioners are held entitled to the relief prayed for in terms of the judgment dated 31-10-2012, passed in Writ Petition No. 20968/2009 from the same date.

Government of the Pakistan Finance Department Regulation Wing Islamabad has issued Notification No. F.No. 1(4) Imp/2012-193 dated 25th February 2014 in connection with the Basic Pay Scales 2011 & Adhoc Allowances to the Contingent Paid Staff and Contract Employees.

According to this Notification the Basic Pay Scales 2011 introduced vide Finance Div Notification No. F.1 (5)/Imp/2011-419 dated 04-07-2011 and the Adhoc Relieves granted from time to time after 01-07-2011 would also be applicable to the Contingent Paid Staff and Contract Employees of the Federal Government paid from the Civil Estimates as well as Defence Estimates subject to the condition that they are employed against the posts in Basic Pay Scales on standard terms & conditions.

Clarification Regarding Pay Protection of Contract Employees on Regularization-Notification by Finance Division

Finance Division, Regulation Wing Islamabad has issued Notification No. F.No. 7(9) R-I/2012-1388 dated 6th March 2014 in connection with the Clarification Regarding Pay Protection of Contract Employees on Regularization/Appointment on Regular Basis. The queries and their answers given by the Finance Division are as under:

i Finance Division’s O.M dated 31st May 2013 does not contain any effective date of implementation. From which date will it take effect?  The said O.M will take effect from the date of its issue i.e 31-05-2013.
ii Whether the pay of employees working on daily wages, short term vacancies and on contract basis, regularized by the Cabinet Sub-Committee is protectable? The pay of only those contract employees (Non-Gazetted) whose appointments have been made on standard terms & conditions in BPS by the competent authority is protectable.
iii Whether employees whose services were transferred from development to non-development side are entitled to pay protection? Pay is protectable of those employees only whose contract appointment in development side was made in BPS-01 to BPS-15 on standard terms & conditions.
iv Whether the pay of contract employees on their regularization in lower grades is protectable or otherwise? Finance Division’s OM clearly states that in case of regular appointment in lower grade pay shall not be protected.
v Whether the contract employees of BPS-01 to BPS-04 who were moved one scale up with effect from 1st July 2007 are entitled to pay protection on their regularization? Yes
vi In case the pay protection is allowed with effect from 31-05-2013 to all back date cases, please clarify about the date of pay fixation regarding date of regularization or implementation of this policy and whether payment of arrears after 31-05-2013 payable or not? As stated against (i) above
vii Whether an employee working in a Development Project on his appointment on regular basis in the Ministry/Division or Department is protectable? As stated against (iii) above
viii Whether the pay of an employee working on contract basis in the provincial Govt who later on joins a regular post in Federal Govt is also protectable? Yes, subject to the conditions as stated against (ii) above.

Qualification Based Teaching Allowance to All School Teachers of Sindh

Government of the Sindh, Finance Department has issued Notification No. FD(SR-III)5/30-2006 dated 13th March 2014 in connection with the Teaching Allowance to All School Teachers of Sindh Province. The Para-3 of the below mentioned Notification has been cancelled.

Here is to mention that Finance Department Sindh had already issued Notification NO. FD(SR-III)5/30-2006 dated 7th June 2010 regarding teaching allowance. The rates of this allowance are as under:

1 Matric with PTC or equivalent Rs. 500/- per month
2 FA/F.Sc with CT or equivalent Rs. 750/- per month
3 BA/MA with B.Ed/M.Ed or equivalent Rs. 1000/- per month.

 

Para-3: Teachers who have already availed benefit of award of higher grade and qualification increment prior to 01-12-2001 shall not be entitled to above qualification based teaching allowance.

Now according to this Notification this Para-3 has been cancelled and thus these teachers will also be entitled to this Teaching Allowance.

News Regarding Increase in Salaries in 2014-15 Budget have been published in various daily papers of 27th March 2014. These Newspapers covered the statement of the Finance Minister that the employees don’t hope for the increase in salaries in the coming budget 2014-2015.

There is a concern among the employees about this statement as they are already facing the financial problems due to the daily increase in the prices.

Govt of the Punjab Technical Education & Vocational Training Authority has issued Notification No. TEVTA/Bud/Ad-hoc/2013 dated 3rd April 2014 in connection with Grant of 10% Adhoc Relief Allowance 2013 for TEVTA & PSIC Employees. The detail of the same is as under:

Technical Education & Vocational Training Authority is pleased to grant 10% Adhoc Relief Allowance 2013 for PCIC & TEVTA employees from its own resources with effect from 1st July 2013.

10% Adhoc Relief Allowance 2013 for TEVTA Employees

10% Adhoc Relief Allowance 2013 shall be admissible on the running basic pay of TEVTA Pay Scales with effect from 01-07-2013.

Grant of Premature Increment on Promotion within the same Scale-KPK Employees

Government of the Khyber Pakhtunkhwa, Finance Department has issued Notification No. FD (SOSR-1) 2-123/2014 dated 21st February 2014 in connection with Grant of Premature Increment on Promotion within the same Scale.

According to this Notification one premature increment is admissible to the employees who are promoted to the higher scale while they are already drawing the pay of that higher post.

In pursuance of the Finance Division Regulation Wing, Islamabad Notification No. F.11 (30) R-2/2010-1150 dated 5th November 2012, regarding Premature Increment on Promotion within the Same Scale, the Competent Authority is pleased to allow 1x premature increment in the pay scales of the higher post in case of fixation of pay on promotion within the same pay scale in all cases of promotion to higher posts having the same Basic Pay Scales. It means the employees having the said promotion, now will be admissible to the following benefits:-

  1. One Advance Increment as Next Stage
  2. One Premature Increment

It means that the employees who are promoted within the same scale will now get two increments instead of one increment.

This Notification also removed the confusion of many employees who were in confusion that according to the Finance Division Notification, they will get only one increment. Now according to this notification they will get two increments.

Pay Protection of Contract Employees on Their Regularization- KPK Employees

Government of Khyber Pakhtunkhwa Finance Department has issued Notification No. FD (SOSR-1) 12-7/2014 dated 6th February 2014 in connection with Pay Protection of Contract Employees on Their Regularization.

According to this Notification Competent Authority is pleased to allow the pay protection of the contract employees (Non-Gazetted) on their regularization with immediate effect. The conditions for the same are as under:

  • The contract appointment has been made on standard terms & conditions, circulated from time to time by the Government of Khyber Pakhtunkhwa.
  • The contract employee has been applied through proper channel and in the same way relieved properly by the appointing authority concerned. This condition will not be applicable on regularization on the same post.
  • The regular appointment/ regularization has been made by the approval of the competent authority.
  • There is npo gap/break/interruption between the regular and contract service.
  • The service rendered during contract period shall not be counted for pension or gratuity purposes.
  • Pay shall not be protected, in case of regular appointment in lower grade.

Clarification of Personal Allowance

Government of the Punjab, Finance Department has issued Notification No. FD.SR-II/9-214/2013 dated 2nd April 2014 in connection with Clarification of Personal Allowance. The detail of the same is as under:

I am directed to refer to the subject cited above and to state that Finance Department is in receipt of certain references for having advice upon the admissibility of Personal Allowance (Increments already earned during the contract period).

The matter has been examined and it is clarified that Personal Allowance cannot be reduced and treated as part of the pay scales of the concerned civil servant till such time he holds the post. However upon fresh appointment, promotion, retirement and posting to another cadre post, the said allowance will be discontinued henceforth.

LHC Judgment Regarding Grant of Special Wapda Allowance @RS-10000/- PM to the Chemical Officers of PEPCO/WAPDA wef 1/09/2009

Lahore High Court has issued judgment on 2nd April 2014 in connection with grant of Special Wapda Allowance @RS-10000/- PM to the Chemical Officers of PEPCO/WAPDA wef1/09/2009. Some points of this decision are as under:

Petitioners have invoked the Constitutional Jurisdiction of this court under Article 199 of the Constitution of Islamic Republic of Pakistan 1973, alleging that the petitioners possessing degree of M.Sc (Chemical Engineering) and M.Sc (Chemical Technology) are entitled to the grant of Special Wapda Allowance at the rate of Rs. 1000/- per month wef 01-01-2009 which has been extended by Wapda and its relating companies/respondents to almost all categories of their employees of BPS-17 and above who posses B.Sc (Engineering and Master Degrees).

That the petitioners were constrained to send legal notice dated 24-10-2011 to the respondents seeking grant of Special Allowances which have been declined through the impugned order dated 03-11-2011. That the impugned order is illegal, arbitrary, discriminatory, violative to the petitioner’s right guaranteed under the Constitution.

Petitioners therefore are entitled to the benefit of Special Wapda Allowance at the rate of Rs. 1000/- per month with effect from 01-09-2009.

For the above reasons the petition is allowed and the respondents are directed to extend the benefit of Special Wapda Allowance to the petitioners in the above terms. Arrears towards Special Allowance in terms of this order shall be paid to the petitioners within a period of 90 days. You read the full details of this judgment on the copy of the decision.
